WHAT IS THE California STEP Act

Stepping is a procedure to:
Show knowledge that the individual belongs to a Criminal Street Gang

Procedure of being STEPPED - HOW IT’S done:
Officer serves
Notice of Determination on the person HE determines belongs to a criminal street gang:

This notice informs you: “You are hereby notified that the above mentioned (written in by officer, Motorcycle Clubs name)  is a criminal street gang engaging in a pattern of criminal activity within the meaning of Penal Code Section 186.22”

Officer completes a “proof of service” by including a photo and fingerprint of “gang member”

 WHY IT’S done:
If agencies “STEP” who they designate as  “gang members”, the element of prior knowledge can then be easily proved.  
The Prosecutor will be able to show:
   
1)     Notice was given  prior to the commission of the crime for which defendant is being prosecuted
    2)    Lay a foundation
    3)    And enter the form into evidence (photo & finger print)

What YOU can do if you are being detained for a traffic stop:
®  
Never accept the notice, sign for a traffic violation but don’t be tricked into agreeing to a lesser charge in lieu of signing the Notice of Determination
®     Don’t give a thumb print AND photo
®   
  Educate the Officer, inform him/her that you’re a Member (Friend, Associate, Supporter) of a Motorcycle CLUB  


 IMPORTANT LEGAL INFORMATION:

When asked to comply with an officers request, BEFORE talking to the officer or giving up your rights,  politely inform the officer that "if YOUR Attorney gives YOU permission to do so, YOU will be willing to comply with the officers request",  HOWEVER you "have made a commitment to your attorney to refuse these requests prior to consulting with your attorney".

When an officer states "I'm going to search you, "OK?" They are asking for "YOUR" permission for the search, this in fact is a request.  Do not agree, the response would be "I will not obstruct or delay your investigation, but I do not give my consent for a search".


 Let them take you to jail 
1)      They MUST have legally made a determination that YOU are a member of a “criminal street gang”
2)      AND some kind of crime must have been alleged against YOU 
3)     
AND that crime was “for the benefit of the “gang”

There is some very interesting related general information on a website "StreetGangs.com". Alex Alonso, the author of the site, has been an expert witness for the defense in over a 100 cases where gang enhancements have been unfairly been applied. Because of the vague definitions of what a criminal street gang is (in CA: 3 people, even if only one commits a crime), any group the government dislikes can become a target. The web site also attempts to explain the positive side of neighborhood street gangs and although that may be a stretch (for me), the site nevertheless has some very important information that clubs should be aware of. Start out by first checking out their mission statement:

I ride one of two Harleys, one being a Fatboy. Any of you that ride one know how a good cross wind will catch your wheels and you have to compensate for this. One night while riding with my wife down a tree lined freeway that blocked the wind from us, we happened to come to an underpass where there were no trees. The wind caught my wheels and I wobbled just a bit but stayed in my lane [no other traffic on the freeway]...but so happened a Highway Patrol Officer was sitting on the on-ramp. A two man unit...they noticed me wobble and proceeded to follow me. They eventually lit me up and told me to take the next exit and stop. I did as told as I was not drinking nor had been, so figured I could explain myself and be on my way. But they did not agree with me and made me do a roadside sobriety tests which I failed as it was winter and I had on many layers of clothing and was constricted in my movements. Without giving me a breath alyzer test they went ahead and arrested me for DUI. Placing me in the patrol car they left my wife and bike on the side of the road [my wife doesn't know how to ride] and took me to a local hospital for a blood test. The test came back negative for alcohol so they change the charges to Dry Wreckless Driving and took me to jail. I was told I would be there for a couple hours and then let loose, however the jailer told me I had to wait 8 hours to sober up first. Pleeaded requests that I was not drunk and wanted to leave fell upon deaf ears.
I was assigned a public defender who I never even talked to or saw until my court date. When my case was called up the public defender told the judge I would accept the charge of Dry Wreckless....I told my attorney that wasn't the case and wanted to explain the difference in the type of Harley I was riding. He told me to keep quiet and did not allow me to address the judge.
I was found guilty of Dry Wreckless and fined $400. I tried to fight it but to no avail...my attorney told me it was a done deal and just accept it. Who the hell was this guy representing?....me or the law. Without the funds to get a reputable lawyer I ended up paying the fine and taking a hit on my drivers record. This was a classic case of being railroaded by the system and my hands tied to do anything about it.

The man is all ways right no matter what thats what they tell me. They have to read you your rights and you have the right to a lawyer not a Public dummy trying to practice law. They told me years ago if we really wan't you we will get you no matter what. I am sure there are a lot of our Brothers out there who will tell you the same thing. Be carefull and watch your ass.
